October 15, 2015 (Nyamilepedia) – The Greater Shilluk Community which is one of the biggest communities in South Sudan’s Greater Upper Nile region has rejected President Kiir’s unilateral decision to create 28 new states saying it violates the recently signed IGAD Compromise Peace Agreement and it’s unconstitutional.
In a statement by the Shilluk intellectual and leaders represented by Joshua Otor Akol, they said the order by President Kiir was unconstitutional, tribally motivated and put some of the Shilluk Counties under the Dinka County of Biliet which they totally reject.
“Cognizant that a federal system of government is a popular demand of the people of South Sudan and the need for the Transitional Government of National Unity to reflect this demand by way of devolution of more power and resources to lower level of governments and to initiate that a federal and democratic system of governance is ensured in the diversities by enacting in a permanent constitution making process,” said Akol, quoting provision of the IGAD Peace agreement.
Joshua Otor Akol representing the Shilluk intellectuals also wonders on what basis and Criteria were the 28 states created, was it on Tribal basis or on County basis or what basis?
Joshua Akol added that if the states were created based on tribal boundaries as it seems, then all Shilluk should be within their same territories and not within other new territories, the same way as all Dinka has been put within their own territories by the Presidents order, However if the States have been created based on County boundaries, then the 4 Shilluk counties of Upper Nile should remain intact and together, but not annexed to Dinka Counties, therefore Shilluk Community totally reject Kiir’s order.
The Shilluk intellectuals further warned that any push to illegally annex Shilluk Counties and Lands of Panyikang and Malakal to Dinka areas of Biliet would lead to major conflict.
Shilluk of Upper Nile is known to be made up of 4 Counties, Pachoda, Mango, Panyikango and Malakal.
However President Kiir’s Presidential order decided to put Shilluks Counties of Malakal and Panyikango under the Dinka Administered Biliet State, a move rejected by the Shilukk Community.
“Naked Land Grab” equals more wars
Meanwhile SPLM-IO commander of Special division Gen. Johnson Olony who also doubles as leader of Shilluk Militia known as “Aguelek” has warned that any move by President Salva Kiir to annex Shilluk lands to Dinka areas will be equals to creating new and endless war between Shilluk and Dinka in Upper Nile.
Speaking to BBC reporter last week after President Kiir’s order to create 28 new States, Gen. Olony said that he was angry about the creation of the 28 new states, adding that he was not optimistic about the peace deal signed in August because of continuous violations by President Salva Kiir’s side.
Johnson Olony said the creation of the new 28 states was a “naked power-grab”, accusing Kiir’s regime of continuing to attack civilians and arming Dinka Militia against other tribes in Upper Nile who Olony blamed for occupying Shilluk areas as a result of one sided support from President Kiir’s government.
Kiir’s Presidential order to create 28 new states, annexed large Shilluk areas binding it under the administration of Dinka Biliet region, the areas annexed include Malakal also known as Makal in Shilluk, Aniekdier, Khor Fullus, Wau Shilluk and one of Shilluks heartland and key area of Panykang.
It’s still not clear as to how and why President Salva Kiir placed alrge shilluk areas under Dinka Administration States in his order, as Kiir issued his Presidential order without any consultation with the people or even the Parliament.
